Section:8 :Notice Of Payment Of Gratuity

Obligation : To issue notices for payment of Gratuity to an eligible employee

Type:Trigger Frequency: Quarterly

Action to be taken:
Ensure that within 15 days of receipt of application under Rule 7 for payment of gratuity, a) if the claim is admissible, issue a notice in Form 'L' specifying the amount of gratuity payable and fixing a date for making the payment, not later than 30 days after the receipt of the application b) If the claim is inadmissible then issue a notice in Form 'M' specifying the reasons for inadmissibility. The notices shall be served personally or by Registered AD to the applicant. If the claimant is a nominee or a legal heir, the employer may ask for such witness or evidence as may be deemed relevant for establishing identity.

Audit Requirement:
On receipt of a notice for payment of gratuity, have notices regarding the claim been sent in the appropriate manner to the claimant ?
