Section:76 :Notice Of Retrenchment

Obligation : To give notice to the prescribed authorities on retrenchment of a Workman

Type:Trigger Frequency: Quarterly

Action to be taken:
If it is desired to retrench, under Section 25-F, a workman who has been in continuous service for not less than one year, give notice of retrenchment in Form P to the Central Government, the RLC (Central) and the ALC (Central) and the concerned employment exchange. Notice is to be submitted by registered post in the following manner:
(a) where notice is given to the workman, within 3 days from the date on which notice is given to the workman
(b) where wages are paid in lieu of notice, within 3 days of the date on which such wages are paid
(c) where retrenchment is carried out under an agreement which specifies a date of termination of service, as specified in Rule 76(c)

Audit Requirement:
Has notice been given on time to the prescribed authorities whenever a workman has been retrenched ?
