Employees Provident Fund and Miscellaneous Provisions Act

Section:Scheme 33, 34 :Declarations From Employees

Obligation : To obtain and furnish employee information to the Commissioner of the PF Fund

Type:Trigger Frequency: Quarterly

Action to be taken:
On an employee joining the company, obtain a PF and Pension Account Number for the employee. If no such number exists, obtain a signed declaration in Form 2 of Employee Particulars and Nomination Details and forward these to the Regional Commissioner.

Audit Requirement:
Does each employee have a PF/Pension Account Number ? If not, has a declaration from the employee been submitted to the PF commissioner ?

18:Particular to be supplied by the employees already employed at the time of commencement.:
Particulars to be supplied by the employees already employed at the time of commencement of the Employees' Pension Scheme.- Every person who is entitled to become a member of the Employees' Pension Fund shall be asked forthwith by his employer to furnish and that person shall, on such demand, furnish to him for communication to the Commissioner particulars concerning himself and his family in the form prescribed by the Central Provident Fund Commissioner.

24:Declaration by persons taking up employment after the fund has been established:
The employer shall before taking any person into employment, ask him/her to state in writing whether or not he is a member of the Employees Pension Fund and, if he/she is, also ask him/her to furnish a copy of the scheme certificate issued by the Commissioner to him/her in respect of the past employment in terms of Paragraph 12 as the case may be. If the person concerned was not in employment previously or had availed of return of contribution in respect of his/her previous employment, he/she shall, on demand by the employer, furnish to him, for communication to the Commissioner particulars concerning him/herself and his/her family in the form prescribed by the Central Provident Fund Commissioner.
Provided that if such person is a person with disability, the aforesaid form Form shall further contain such particulars as are necessary for each person.

Every person who is required or entitled to become a member of the Fund shall be asked forthwith by his employer to furnish and shall , on such demand, furnish to him, for communication to the Commissioner, particulars concerning himself and his nominee required for the Declaration Form in Form 2. Such employer shall enter the particulars in the Declaration Form and obtain the signature or thumb-impression of the person concerned. Employees Provident Fund Scheme, 1952
Chapter:Declaration, Contribution Cards and Returns| 34:Declaration by persons taking up employment after the Fund has been established.:
The employer in relation to a factory or other establishment shall, before taking any person into employment, ask him to state in writing whether or not he is a member of the Fund and if he is , ask for the Account Number and/or the name and particulars of the last employer. If he is unable to furnish the Account Number, he shall require such person to furnish and such person shall, on demand, furnish to him for communication to the Commissioner, particulars regarding himself and his nominee required for the Declaration Form. Such employer shall enter the particular in the Declaration From and obtain the signature or thumb-impression of the person concerned :

Provided that in the case of any such employee who has become a member of the Family Person Fund under the Employees' Family Pension Scheme, 1971, the aforesaid Declaration Form shall also contain such particulars as are necessary to comply with the requirements of that Scheme.
