Sales Promotion Employees (Conditions Of Service) Act

Section:R.13 :Recall from earned leave

Obligation : To pay an employee a travel allowance for the journey undertaken by him on recall from leave

Type:Trigger Frequency: Quarterly

Action to be taken:
The establishment may recall a sales promotion employee on leave if the employer considers it necessary to do so and in the event of such recall the employee shall be entitled to travelling allowance for the journey undertaken by him to join duty if at the time of recall the employee is spending his leave at a place other than his headquarters.

The travelling allowance shall be determined in accordance with the rules of the establishment governing travelling allowance for journeys.


Audit Requirement:
If any sales promotion employees have been recalled from leave, have they been paid travel allowance for any journey ?

(1) The establishment may recall a sales promotion employee on leave if the employer considers it necessary to do so and in the event of such recall the employee shall be entitled to travelling allowance for the journey undertaken by him to join duty if at the time of recall the employee is spending his leave at a place other than his headquarters.
(2) The travelling allowance which shall be paid to a sales promotion employee under sub-rule (1) shall be determined in accordance with the rules of the establishment governing travelling allowance for journeys undertaken by the employees in the course of their duties.
