The Government of Bihar has notified The Social Security (Bihar) Rules, 2025, vide Gazette Notification No. COSS 10-01/2021 dated 9 December 2025, in exercise of powers under Sections 154 and 156 of the Code on Social Security, 2020. These Rules replace several earlier State rules and provide a consolidated framework for social security administration in Bihar.
1. Scope and Commencement
Title: The Social Security (Bihar) Rules, 2025
• Extent: These rules extend to the entire state of Bihar.
• Commencement: They shall come into force from the date of their publication in the Official Gazette.
• Supersession: These rules repeal and replace the following earlier regulations:
• Bihar Maternity Benefit Rules, 1964
• Bihar Payment of Gratuity Rules, 1972
• Bihar Building and Other Construction Workers Rules, 2005
• Bihar Unorganized Workers Social Security Rules, 2015
2. Social Security Organizations (Chapter II)
Bihar Unorganized Workers Social Security Board
• Term: Nominated members shall hold office for a maximum of three years. They may be re-nominated for up to two terms.
• Composition: The Board shall include representatives from unorganized workers’ associations and employers’ associations, with at least two active unorganized workers as members.
• Meetings: The Board shall meet at least three times in a year.
Bihar Building and Other Construction Workers Welfare Board
• Chairperson: The Secretary, Principal Secretary, or Additional Chief Secretary of the Labour Resource Department.
• Composition: The Board shall consist of 15 nominated members representing various government departments (Education, Finance, Social Welfare, etc.), building workers, and employers.
• Meetings: The Board shall meet at least once every four months.
3. Gratuity Provisions (Chapter IV)
• Nomination (Form-IV):
o Existing employees must submit nominations within 90 days of commencement of these rules.
o New employees must submit nominations within 30 days of completing one year of service.
• Application for Gratuity (Form-VII):
o Eligible employees or their authorized representatives must apply within 30 days of gratuity becoming payable.
o Legal heirs must apply within one year from the date gratuity becomes payable.
• Employer Response: Within 15 days of receiving an application, the employer shall issue either:
o A notice for payment (Form-VIII), or
o A notice of rejection specifying the reasons.
• Appeals: Appeals against the decision of the competent authority must be filed with the Labour Commissioner-cum-Appellate Authority within 60 days.
4. Employees’ Insurance Court (Chapter III)
• Appeals: An insured person or the Corporation may appeal against a decision of the Medical Board or Medical Appeal Tribunal within 90 days.
• Procedure: Applications (Form-II) must be filed in triplicate and must state the facts, jurisdiction, and relief claimed.
• Fees: A fee of ?100 shall be payable for applications under Section 49.
5. Welfare Cess (Chapter VII)
• Payment Timeline: Cess must be paid within 30 days of project completion or assessment.
• Long-term Projects: For projects exceeding one year, cess must be paid annually within 30 days of completion of each year.
• Appeal Fees: Filing an appeal regarding cess requires payment of a fee equal to 1% of the disputed amount or penalty.
6. Records, Returns, and Monitoring
• Unified Annual Return (Form-XVIII): Employers must upload a unified annual return electronically on the government web portal by the end of each financial year.
• Employment Information Return (Form-EIR): Employers must furnish yearly returns detailing recruitment and vacancies to the concerned Career Centre within 30 days of March 31.
• Compounding of Offences: Authorized officers may issue electronic compounding notices in Form-XXIII for eligible offences.
7. Bihar State Social Security Fund
The Fund shall be established with contributions from:
• Grants from the State and Central Governments
• Registration and renewal fees from beneficiaries
• Donations and Corporate Social Responsibility (CSR) funds

The Government of India vide notification S.O. 1730 (E) has appointed the 3rd day of May 2021 as the date on which the provisions of section 142 of the Code on Social Security 2020 shall come into force. It is therefore requested to ensure the compliance for the above provision with immediate effect. Please refer to the notification for more information.
