The ESI has made certain changes to the rules applicable for the period 1.1.2021 to 30.6.2021. This has been announced to help those affected. According to the amendment, those appointed before 1st January 2020 may claim benefit for the period January to June 2021 if the contributions payable for him from April - September 2020 is for a minimum of 39 days, or the contribution payable for the period October 2020 to March 2021 is for a minimum of 78 days.The daily rate of sickness benefit will be calculated on the standard benefit rate during the periods April to September 2020, and October 2020 to March 2021. Additionally, women will be eligible for maternity benefit for confinement anticipated during January - June 2021, provided contributions made in the periods of October 2019 - March 2020, and April 2020 to September 2020 were payable for a minimum of 35 days. |

ESIC vide circular No. T-11/13/56/02/2020 Rev.II has acknowledged to all regional and sub regional offices regarding judgement of the Honble Supreme Court of India that payment of conveyance allowance as per present case does not fall under definition of term "wages" which means "all remuneration paid or payable in cash to an employee, if the terms of the contract of employment, express or implied, were fulfilled and includes [any payment to an employee in respect of any period of authorised leave, lock-out, strike which is not illegal or layoff and] other additional remuneration, if any, [paid at intervals not exceeding two months], but does not include (a) any contribution paid by the employer to any pension fund or provident fund, or under this Act ; (b) any travelling allowance or the value of any travelling concession ; (c) any sum paid to the person employed to defray special expenses entailed on him by the nature of his employment ; or (d) any gratuity payable on discharge" . Therefore, concluded that conveyance allowance shall not form part of the wages of the employees and the judgement hold good with effect from 8th March 2021. |

The matter of extending the benefits under ESI Act, 1948 to construction site workers
have been examined at stretch and it is decided to revisit the Instruction No. 4/99 circulated
vide letter no. P-12(l1)-11127/99-Ins.IV dated 14thJune 1999.
The Construction site workers who were kept out of coverage of ESI Act till date can
now be covered with the implementation of IT Roll Out "Any time, Anywhere". ESIC services
will be available to these mobile and migratory workers with no geographical barrier.
Also with user friendly instruction issued recently, the scope of medical care
(primary, secondary and superspeciality treatment) is wide now and can be availed by these
construction site workers. In other words, ESI Scheme is not restricted to our own dispensaries
but the medical services can be availded at empanelled private dispensary/diagnostic Centre
where ESIC is unable to provide services.
Further, if any Construction workers at site cannot avail ESI Scheme, they can be
granted exemption in suitable cases.
In view of above, all RDs/Directors/Jt. Director Incharges are requested to conduct
survey in the first phase of Public Limited Companies engaged in construction activities in the
implemented areas and submit a report latest by 31/1/2011. |
