We would like to apprise that vide notification dated 14/03/2024, the Government of Haryana prescribes certain conditions in respect of any factory which apply for the exemption for employing women in the factory during night shift i.e. between the hours of 07.00 PM to 06.00 AM, in respect of their Safety and Security. Vide notification LAE05-12021/31)/2/2022-BSEC-DOF, the government of Andhra Pradesh has released certain conditions subject to which women will be allowed to work in factories during the night shift, after 7 pm and before 6 am. Factories must ensure: adequate safety guards to protect the health and safety of female employees, and amenities like restrooms, lunch rooms, creche, and toilets. There must also be measures to ensure protection against sexual harassment. Additionally, transport facilities from the factory to the doorstep of the female employee must be provided.

The Tamil Nadu Factory Rules now include petrol, diesel, and LPG dispensing pumps under the definition of Factory. Therefore, all petrol, diesel, and LPG dispensing pumps must be registered under Sections 2(m)(i) and Section 85(1) of the Factories Act. All other provisions and enactments will now be enforced under Section 2(cb) and Section 87 of the Factories Act.

Through an amendment made to Schedule XX of the Factory Rules, which talks about managing, manufacturing, and handling asbestos or use of asbestos in any form, the following changes have been instrumented:
I. the Schedule is applicable to all manufacturing processes that involve workers exposure to asbestos or products containing asbestos;
ii. It is the responsibility of the occupier of the factory to comply with the provisions of the Schedule pertaining to these workers;
iii. The occupier shall prepare procedures and practices in terms of research and technological progress for approval by the Chief Inspector.

The state has announced revised working conditions under the Factories Act, exempting from Sections 51, 54, 55, and 56 for a period of 3 months. The revised conditions include:
i. Adults can work for a maximum of 12 hours a day, and 72 hours a week;
ii. periods of rest such that no one works longer than six hours without being allowed a minimum rest of half an hour
iii. wages in proportion to Himachal Pradesh minimum wages under Minimum Wage Act;
iv. Section 59 on overtime remains same.

Punjab Amendment: Through the Punjab Amendment made to the Factories Act through an Ordinance, the state government has issued a notification increasing the threshold limit for its applicability. It will now be effected in Factories with 20 or more workers (as opposed to an earlier number of 10) working with the aid of power; and in factories with 40 or more workers (as opposed to an earlier number of 20) working without the aid of power. Quarterly overtime hours have also been increased from 75 to 115 hours.

The new directive from the Supreme Court quashes Gujarats previous notification that exempted industries from provisions in the Factories Act pertaining to overtime wages, weekly hours, intervals, and daily hours on the grounds of Covid-19. The Supreme Court mandates that all overtime wages be paid to employees since the date of the mentioned notification.

The Uttar Pradesh Government, with the introduction of Section 5(A) in the Factories Act, 1948, has allowed special powers to the state to exempt factories from the provisions of the Act temporarily. This is applicable to all new factories or factories that commence operations within 1000 days after the implementation of the Factories (Uttar Pradesh) Act, 2020, for a period of 1000 days from the date of commencement of production. i. Maximum working hours for any adult worker in a factory shall be 12 hours a day and 72 hours a week
ii. Maximum period of work for adult worker in factory shall be 6 consecutive hours, followed by a minimum of half an hour interval of rest
iii. No female worker may work between 7pm and 6am
iv. Wages for new hours of work must be in proportion to to existing wages

Under the latest ordinance issued by the government of Assam which makes state amendments to the Factories Act, it has been notified that:
i. The numbers "twenty" and "forty" have been substituted in place of "ten" and "twenty" as appearing in sub-clause (i) and (ii) of Section 2(m) respectively. These numbers make reference to the number of workers operating in factories with and without the aid of power; and
ii. The same changes have also been made in Section 85(l), clause (i) of the Principal Act.

A special exemption has been granted by the Madhya Pradesh government to all factories registered under the Factories Act for a period of 3 months. Exemptions have been allowed toward sections 51(weekly hours), 54(daily hours), 55(Intervals of rest) and 56(spread hours), in accordance with clause iii and iv of sub-clause (3)(a) of section 65. The stipulated conditions include:
a. A maximum of 12 working hours a day and 72 working hours a week for any adult worker in a factory
b. Working period for any adult worker in a factory to be no longer than six continuous hours with a rest interval of at least half an hour immediately after
c. Overtime to be paid in accordance with Section 59 of the Factories Act, 1948

Under Section 51, 54, 55, 56 - A special exemption has been granted by the Madhya Pradesh government to all factories registered under the Factories Act for a period of 3 months. Exemptions have been allowed toward sections 51(weekly hours), 54(daily hours), 55(Intervals of rest) and 56(spread hours), in accordance with clause iii and iv of sub-clause (3)(a) of section 65. The stipulated conditions include:
a. A maximum of 12 working hours a day and 72 working hours a week for any adult worker in a factory

In keeping with the current scenario, the Punjab Government has allowed certain flexibilities in the Factories Act, 1948 which will apply for the next three months. The provisions include:
(a) maximum working of 12 hours a day instead of 9 hours (section 54)
(b) Spread over of maximum 13 hours a day instead of 10.5 hours (section 56)
(c) Twice the rate of ordinary wages for workers as provided for overtime(section 59)
